If you believe a solar UCC filing is inaccurate or unauthorized, obtain the complete record and identify exactly what you dispute. Ask for the agreement and authority supporting the filing, preserve evidence and seek the appropriate correction or termination. A complaint or UCC-5 information statement does not itself invalidate a financing statement.

Separate a filing dispute from a loan dispute

You may dispute the recorded debtor name, collateral, filing authority or association with your property. You may also dispute a loan’s origin, sales representations, funding or servicing. These concerns can overlap, but one response may not resolve them all. Identify the issue in each document rather than labeling the entire situation fraud without evidence.

The existing unauthorized solar loan guide covers broader consent and account concerns. This article focuses on the UCC record, its supporting authority and the evidence needed to request a filing response.

No signature on the UCC form is not the whole test

A public financing statement may not carry your signature even when filing was authorized through another record. Article 9 can treat entry into an appropriate security agreement as authorization for a financing statement covering the collateral described. Conversely, filing-office acceptance does not prove the filer had the required authority.

California’s Secretary of State guidance notes that initial financing statements and amendments do not require debtor or secured-party signatures on the filed form. For an enacted example of authorization and effectiveness rules, see Texas §§ 9.509–9.510. Ask for the signed agreement, incorporated terms and any relevant electronic-signature record instead of deciding authorization solely from the UCC form.

Build an evidence packet before escalating

Dispute evidence checklist
Record What to mark
Initial UCC and amendment chain Filing number, office, dates, debtor identity, collateral and secured parties.
Agreement and alleged authorization Signatures, dates, pages, collateral terms and electronic-signature audit information, if available.
Your factual correction What you believe is wrong and the documents supporting that position.
Property/identity records Only the records needed to explain a wrong person, address or property match; protect sensitive identifiers.
Correspondence Requests sent, delivery receipts, responses and inconsistent explanations.
Transaction impact Actual title condition, delayed closing notice or other documented effect; do not invent losses.

Preserve original files and metadata where possible. Make a working copy for notes. Avoid editing the underlying electronic agreement or relying only on a cropped image.

Send a precise request to the responsible party

  • Identify the initial financing statement and the exact inaccurate or unauthorized item.
  • Request the agreement and other records the company relies on for filing authority.
  • Explain the correction or termination you seek and attach relevant evidence.
  • Ask for the current secured party of record, the responsible review contact and written results.
  • Keep proof of delivery and a dated log. Use contractual notice requirements where applicable.
  • If a statutory demand is intended, obtain advice about the governing law and required form, authentication or signature and recipient.

If there is an active home sale or refinance, give title and the mortgage lender the dispute status without promising a release. A pending investigation may not satisfy their closing condition.

What a UCC-5 information statement can and cannot do

An information statement provides a way to put a claim of inaccuracy or wrongful filing into the record. It is not a termination, a court judgment or an automatic amendment. In Texas, § 9.518 states that filing an information statement does not affect the effectiveness of the initial financing statement or other filed record. See Texas Chapter 9.

Use an information statement only after considering its purpose, content and public nature. Do not include unnecessary Social Security numbers, financial account details or identity documents. Ask a lawyer whether an information statement, formal demand, filing-office procedure or court process fits the actual facts.

When to seek legal or consumer-protection help

A licensed attorney can assess filing authority, applicable termination duties, disputed collateral and available relief. Texas has a separate fraudulent-filing provision in § 9.5185, illustrating why a state-specific review matters. It does not mean every mistake is fraud or every complainant is entitled to a particular remedy. Use the state-law starting points to locate the relevant authorities.

For an eligible loan or financial-product issue, the CFPB complaint process can route a complaint for response. If identity theft is suspected, IdentityTheft.gov provides an official recovery starting point. Complaints and reports do not themselves terminate filings, cancel debts, suspend payments or extend court deadlines.

Do not stop payments solely because you submitted a dispute. Get advice about the actual obligation and any written hardship or dispute arrangement. If legal papers are served or a closing deadline is approaching, promptly obtain professional help.

Example: the filing names a person with a similar name

Hypothetical example.

A homeowner finds a solar UCC result under a similar name but does not recognize the account. The homeowner obtains the complete record, asks the filer to explain the identity match and supplies limited evidence of the discrepancy. The matter is treated as an identity or indexing question until the facts support a conclusion. No unsupported termination is submitted.

Frequently asked questions

Can a solar company file UCC-1 without my signature on that form?

The filed form may not require your signature. Authorization can arise through another agreement under applicable law. Request the supporting records before concluding that an unsigned UCC form was unauthorized.

Will a UCC-5 remove an unauthorized solar lien?

No. An information statement records a claim of inaccuracy or wrongful filing; it does not itself terminate or invalidate the financing statement.

Does filing a CFPB complaint cancel the debt?

No. A complaint is a separate response process. Debt resolution and any required UCC filing action must be addressed independently.

What if the lender refuses to provide authority?

Preserve the requests and responses and seek legal advice about applicable duties and remedies. A refusal does not authorize you to make a false or unsupported termination filing.
