Solar Lease and PPA Problems

A solar lease generally charges for use of equipment; a PPA generally charges for energy produced. Both may run for many years and include annual escalators, transfer requirements, purchase options and end-of-term obligations.

Confirm whether it is a lease or PPA

Look at how charges are calculated, who owns the equipment and who receives incentives. Record the term, escalator, minimum payments, production guarantee if any, maintenance duties, insurance provisions and end-of-term options.

Compare expectations with the contract

A sales proposal may emphasize an estimated first-year saving while the agreement describes rate changes over time. Compare actual bills and production with the assumptions, but distinguish a forecast from a contractual guarantee. Weather, usage, utility rates, shading and equipment condition can all affect results.

Plan early for a move

Transfer, prepayment and purchase options may have different prices and approval steps. Ask the provider for current written procedures and quotes well before listing or closing. A buyer may need to qualify, and a purchase option may be available only at specified times.

Address performance through the correct channel

Because the equipment owner may be responsible for maintenance, follow the notice and service procedure in the agreement. Save production exports, error messages, utility bills, photographs and every service-ticket number.
