You may be able to refinance with an active solar UCC filing. The next step depends on the agreement, collateral, filing location, lien priority and mortgage program. Ask the mortgage lender and title team which specific condition must be satisfied before requesting termination or subordination.

First ask what is holding up the refinance

A lender may be asking about monthly debt, equipment ownership, appraisal treatment, title priority or several of these at once. A provider’s generic statement that its filing “only covers the panels” may not answer the lender’s actual question. Get the condition in writing and attach the relevant record.

Request the note, security agreement, complete UCC record chain and any county fixture filing. Give the lender consistent documents; do not rely on a balance screenshot or an installer’s sales description.

Subordination, termination and release are different

Match the document to the problem
Document/action Typical purpose What it does not establish
Subordination agreement Adjusts priority relative to an identified mortgage or interest. That the solar debt has been forgiven or the filing erased.
UCC termination Ends the effectiveness of a financing statement to the extent authorized. That every payment or equipment obligation ended.
Collateral release/amendment Changes collateral coverage or releases an identified interest under written terms. That unrelated filings or contracts are resolved.
Consent or transaction accommodation Addresses a specified refinancing condition if agreed by the provider and accepted by lender/title. That every future refinance receives the same approval.

A temporary accommodation can include conditions for later filing or continued contract rights. Ask the provider to explain those terms and have the lender/title team review them before treating the issue as closed.

How Fannie Mae distinguishes common solar arrangements

Fannie Mae’s B2-3-04 solar panel guidance requires mortgage lenders to determine ownership and financing terms. It distinguishes financed fixtures appearing in land records from separately financed equipment treated as personal property. These distinctions can affect debt-to-income, combined loan-to-value and appraisal treatment; they are separate questions.

In the guide’s fixture-financing scenario, a fixture filing senior to the mortgage must be subordinated. That does not mean every solar UCC filing needs identical subordination. A precautionary filing for a leased system also has different treatment. The lender must review the agreement rather than classifying the record from its title alone.

Fannie Mae guidance applies to loans delivered under its requirements. It does not dictate every lender’s product or replace state priority law. Ask your lender which guide provision and additional requirements apply.

Documents to send before the rate-lock deadline becomes urgent

  • Mortgage lender’s exact written solar-related condition and refinance contact.
  • Solar loan, lease or PPA, security agreement and amendments.
  • Current statement showing payment and balance; payoff quote if payoff is proposed.
  • Initial state UCC filing and any county fixture filing, with related amendments.
  • Title report and property-tax bill, including any PACE assessment.
  • Provider’s current subordination, consent, payoff or release procedure.
  • Property and loan details requested by the provider through a secure channel.
  • The proposed document and final executed/recorded evidence required by lender or title.

Ask about expected processing and prerequisites early. Do not assume a rate lock will be extended or a provider’s document will satisfy the lender unchanged. Keep quote expiration dates and closing requirements in the same tracking sheet.

Coordinate the three-party review

Refinance document flow
  1. Lender/titleSpecify the condition and acceptable document.
  2. Solar providerReview the request and issue agreed paperwork.
  3. Lender/titleConfirm acceptance and required recording evidence.

Name one person to track each open item. Record whether the request is merely submitted, conditionally approved, signed, recorded or accepted. Those are distinct milestones. If the provider changes its requirements, forward the written change to the mortgage team.

PACE requires its own eligibility review

A PACE assessment is not resolved by ordinary equipment UCC paperwork. Give its assessment documents to the lender and title professional. Fannie Mae has specific PACE restrictions and a limited qualifying subordinate-PACE exception; eligibility requires review of the actual structure and guide conditions. See the PACE eligibility section.

If you are unsure whether you have PACE, check the property-tax bill and financing agreement rather than guessing from a company name. Do not count an assessment payoff as completed until the responsible parties confirm the required evidence.

Example: title priority and monthly debt are separate

Hypothetical example.

A mortgage lender accepts a provider’s subordination document for a fixture filing. The homeowner still has a monthly solar payment. Resolving priority does not automatically remove that payment from underwriting or cancel the solar debt; the lender must complete its remaining review.

Primary sources and further reading

Frequently asked questions

Do I have to pay off solar to refinance?

Not always. Some arrangements can proceed with documentation, subordination or another accepted accommodation. PACE and particular mortgage products may have different requirements.

Does subordination cancel a solar UCC filing?

No. It addresses priority under its terms. The filing and underlying payment obligation may remain.

Why does my lender need the security agreement?

It helps determine collateral rights, whether repossession is permitted, ownership, debt treatment and applicable underwriting requirements. The UCC record alone may not provide enough information.

Can I terminate the UCC myself to close faster?

A closing deadline does not create filing authority. Unauthorized termination can be ineffective and create additional problems. Have the applicable law and record reviewed.
