Florida, Texas and California use state versions of UCC Article 9, but the filing office, record procedures and available dispute remedies must be checked for the actual transaction. Begin by distinguishing an ordinary UCC financing statement from a fixture filing in county land records. No state label alone tells you that a solar debt is canceled.

A state-by-state starting map

Official starting points for homeowner records
State Central UCC starting point Fixture filing check Termination reference
Florida Division of Corporations UCC information. County real-property recording office; check Chapter 679 filing rules. Florida Statutes § 679.513.
Texas Texas Secretary of State UCC services; confirm the initial filing office. Local mortgage-recording office under § 9.501, subject to statutory exceptions. Business & Commerce Code § 9.513.
California Secretary of State filing guidance. County real-property records as described in SOS filing guidance. Consult Commercial Code § 9513 and current forms/procedures.

This is a research starting point, not a determination of which state’s law controls your agreement or perfection. Debtor location, property location, collateral and filing type can matter. Ask a title professional or attorney about cross-state situations.

Florida solar UCC filings: identify the office and request

Florida’s enacted Article 9 is in Chapter 679. Use § 679.5011 to identify the filing office for the record involved; a fixture filing and an ordinary equipment financing statement should not be treated as the same search. The Division of Corporations UCC information page provides the official starting point for central filing information.

For termination, § 679.513 distinguishes consumer-goods financing statements from other cases. Under its consumer-goods provisions, termination is required when the stated absence of secured obligations/commitments or lack of initial filing authorization applies. The compliance rule is one month after the secured obligations and commitments end, or, if earlier, 20 days after receipt of a signed demand. Other cases have stated demand-based conditions and may call for sending the termination to the debtor or filing it.

Before relying on that rule, confirm classification, remaining obligations, proper demand and receipt. A household rooftop system should not be classified solely from a sales label. Keep proof of payoff and demand delivery in addition to the UCC record.

  • Record the initial filing number and secured party of record.
  • Ask whether county fixture records also require action.
  • Separate UCC termination from a mortgage release or PACE assessment payoff.
  • For cancellation notices and sales-contract questions, use the existing Florida cancellation guide; it answers a different question.

Texas solar UCC filings: priority and disputed records

Texas Business & Commerce Code Chapter 9 contains the filing-office rule (§ 9.501), authorization rule (§ 9.509), effectiveness rule (§ 9.510), termination provision (§ 9.513) and information-statement provision (§ 9.518). Read them together rather than treating a form submission as sufficient legal authority.

Under § 9.501, ordinary filing generally goes to the Secretary of State, while a fixture filing is directed to the office for mortgage records on the related property, subject to the statute’s exceptions. Check both the record type and the office actually used. The official UCC-3 instructions help distinguish a termination from other amendment actions.

Section 9.5185 separately addresses fraudulent filings and includes procedures and potential court relief. A mistaken address or disputed sales promise is not automatically proof that the statute’s requirements are met. Have a lawyer assess the evidence and the proper procedure; do not use a generic complaint as a substitute for relief.

  • Keep the initial number and amendment chain together.
  • Ask title whether a fixture filing’s priority is the closing issue.
  • Treat UCC-5 as an information statement, not termination.
  • For contract cancellation rather than filing status, see the existing Texas cancellation guide.

California solar UCC filings: read the complete record chain

The California Secretary of State filing guide explains where different records are filed and how they appear in searches. It points fixture filings to county real-property records and describes central UCC filing procedures. The official forms page is the starting point for current state forms and instructions.

A common source of confusion is a record that remains searchable after termination. The SOS explains that a termination is indexed with the associated filing and generally does not change the original record’s status in the index. Ask for the linked termination and its acknowledgment; a visible original entry is not conclusive evidence of an ongoing effective filing.

The state’s guidance also explains that an information statement does not remove or change the disputed information. Filing-office acceptance and the absence of signatures on a filed form do not resolve whether the filer had authority. For termination duties under Commercial Code § 9513, verify the current statutory text and classification with qualified counsel before relying on a specific deadline; the correct deadline depends on the statutory conditions and the facts.

  • Search the correct debtor name and obtain the linked amendments.
  • Check county records separately if a fixture filing is involved.
  • Keep account payoff proof separate from filing evidence.
  • For installation and cancellation disclosures, use the existing California cancellation guide.

What is consistent across these homeowner workflows?

A repeatable state-law review
  1. FindIdentify the document, office and governing-law question.
  2. CompareRead the agreement, filing chain and statutory conditions.
  3. ConfirmRequest the authorized action and preserve filed proof.

The same label can conceal different documents. A company may call an equipment financing statement a lien, while a tax bill shows a PACE assessment and title identifies a fixture filing. Create a separate row in your checklist for each instrument and the action each professional requires.

A UCC termination does not cancel an underlying loan by itself. A debt settlement does not automatically update every filing office. A filing-office search is useful evidence, but not a legal opinion about ownership, priority or remedies.

Choose the next guide by the problem you need to solve

Expansion to another state should begin with its enacted Article 9, official filing office guidance, county recording practices and applicable consumer resources. A page that simply swaps the state name without verifying those details would not give homeowners useful additional guidance.

Primary sources and further reading

Sources support the specific distinctions described above. State law, filing-office procedures and mortgage guidance should be rechecked before a transaction or legal demand.

Frequently asked questions

Does Florida treat every solar UCC filing as a mortgage?

No such blanket conclusion should be drawn from the state name. Review the actual instrument, collateral, filing type and title requirements under the applicable law.

Where should I look for a Texas solar fixture filing?

Section 9.501 directs fixture filings to the office designated for mortgage records on the related property, subject to statutory exceptions. Ordinary UCC filings generally use the Secretary of State.

Why does my California UCC record still say active after termination?

The Secretary of State explains that termination generally does not change the original record’s status in the index. Obtain the linked termination and have its effect reviewed.

Do these state guides explain how to cancel my solar contract?

They focus on UCC records. Contract cancellation, loan resolution, equipment ownership and filing termination are separate questions; use the linked existing state cancellation guides for that topic.
